Terms of Service for balivisauk.com (Bali Visa UK)

Last Updated: October 26, 2023

Welcome to balivisauk.com, operated by Bali Visa UK (“the Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website and the visa consulting and facilitation services (“Services”) we provide. By accessing or using our Services, you agree to be bound by these Terms. Please read them carefully before proceeding.

By engaging with balivisauk.com, you acknowledge that you have read, understood, and agree to these Terms. If you do not agree with any part of these Terms, you must not use our Services.

1. Scope of Service

Bali Visa UK provides professional consulting and facilitation services for individuals and entities seeking Indonesian visas. Our Services include, but are not limited to, providing information on visa requirements, assisting with application form completion, compiling necessary documentation, submitting applications to the relevant Indonesian government authorities on your behalf, and tracking application status.

IMPORTANT DISCLAIMER: We facilitate the visa application process; we do not issue visas. The decision to grant or refuse a visa, and the processing time thereof, rests solely with the Indonesian government authorities (e.g., Directorate General of Immigration of Indonesia, Indonesian Embassies, or Consulates). We do not guarantee visa approval, nor do we guarantee specific processing times. Any information provided by us regarding visa requirements, eligibility, or processing times is based on the latest available information from Indonesian government sources and is subject to change without prior notice. We shall not be held responsible for any changes in government policies, regulations, or decisions that may impact your application.

Our role is to streamline and simplify the application process based on the information and documents you provide. We act as an intermediary and consultant, not as a decision-making body for visa approvals.

2. Client Responsibilities

As a Client, you are solely responsible for:

  • Providing accurate, complete, and truthful information and documentation required for your visa application. Any false, misleading, or incomplete information may lead to the refusal of your visa application by the Indonesian authorities, and we bear no liability for such outcomes.
  • Ensuring that your passport is valid for at least six months beyond your intended period of stay in Indonesia and has sufficient blank pages for visa stamps.
  • Reviewing all application forms and documents prepared by us on your behalf for accuracy before submission.
  • Complying with all Indonesian immigration laws, regulations, and any conditions attached to your visa.
  • Paying all applicable fees, including our service fees and any government-mandated visa fees.
  • Notifying us immediately of any changes to your personal circumstances or travel plans that may affect your application.

3. Fees and Payment

Our fees are charged for the consulting and facilitation services we provide. These fees are separate from, and do not include, any visa application fees, biometric fees, or other charges levied directly by the Indonesian government or its authorized agencies. Government fees will be clearly communicated and, where applicable, collected by us for remittance to the relevant authorities, or you may be instructed to pay them directly.

All fees are quoted in GBP (Great British Pounds) unless otherwise specified. Payment must be made in full before we commence the processing of your application. We accept various payment methods as indicated on our website or through direct communication. Failure to make timely payments may result in delays or cessation of our Services.

4. Refund Policy Reference

Our Refund Policy outlines the conditions under which refunds may be issued. Please refer to our dedicated Refund Policy page for comprehensive details regarding eligibility, processing, and timelines for refunds. Generally, our service fees are non-refundable once we have commenced work on your application, which includes, but is not limited to, initial consultation, document review, or application submission. Government fees, once submitted to the authorities, are typically non-refundable regardless of the application outcome.

5. Limitation of Liability

To the maximum extent permitted by law, Bali Visa UK, its directors, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; (iii) any content obtained from the Services; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

Our total aggregate liability to you for any and all claims arising out of or in connection with these Terms or the Services shall be limited to the amount of the service fees you paid to us for the specific service from which the liability arose. We are not liable for any delays, refusals, or other issues arising from the actions or inactions of the Indonesian government authorities or third-party service providers (e.g., courier services, payment processors).

6. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from any cause beyond our reasonable control, including, but not limited to, acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, epidemics, pandemics (including government-mandated lockdowns or travel restrictions), strikes, or shortages of transportation facilities, fuel, energy, labor, or materials. In such events, our obligations will be suspended for the duration of the Force Majeure event.

7. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Indonesia, without regard to its conflict of law provisions. Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or invalidity thereof shall be exclusively settled by the competent courts of Indonesia. Before resorting to formal legal action, both parties agree to first attempt to resolve any dispute through amicable negotiations in good faith.

8. Modification of Terms

Bali Visa UK reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, in whole or in part, please stop using the website and the Services.
